Caddick was charged with a Level 1 offence, point 1.4 which sites as a punishable offence: "Using language that is obscene, offensive or insulting and/or the making of an obscene gesture." The charge related to an incident during the 14th over of the second day's play of the fourth Test match against Australia (27 December) when Caddick was seen to make a gesture. The hearing took place on Saturday morning (28 December) and was attended by ICC match referee Wasim Raja, umpires Dave Orchard, Russell Tiffin and Darrell Hair, England coach Duncan Fletcher and Caddick.
