A Mumbai court on Monday remanded Bollywood actor Salman Khan to judicial custody till October 21 in a hit-and-run case after rejecting his plea for bail. Rejecting the request for bail, Magistrate S.Y. Shisode observed that ongoing investigations demanded Salman's presence. Salman had allegedly driven a vehicle into a bakery at Bandra on September 28, killing one person and injuring four others. The Magistrate observed that the charge-sheet had not been filed and the investigations were still in progress. Salman has been charged under section 304 IPC, an offence that can be tried by a sessions court. Therefore, this court had no jurisdiction to grant bail, said the Magistrate while rejecting the bail petition. Jurisdiction to grant bail has to be on the basis of a well-settled principle in regard to the circumstances of the case, the Magistrate said. Bail cannot be granted in this case in the light of police allegations that Salman was at the wheel and under the influence of liquor at the time of the accident, he said. Salman’s earlier request for bail on October 10 had also been rejected. He had been remanded to police custody then till October 14. A visibly depressed Salman appeared in the court on Monday, sporting a stubble. On his part, Public Prosecutor M.R. Raut said since Salman’s interrogation had been completed police custody of the actor was no more necessary. He said the court could use its discretionary powers to grant him bail if necessary. The police, Raut argued, was not opposing his bail. If the court was inclined to grant him liberty, then Salman could be asked to attend the police station regularly, Raut contended.
